In the terms of these three we precise the followings: we are doing marketing activities across multiple social media platforms, we provide technological solutions for trading on the financial markets via our regulated partners, we provide educational contents about financial markets which are not constitute as financial advices, instead it’s a general how to approach. In summary The Company provides global solutions for individuals who want to learn more about the financial markets and develops in-house strategies using its own proprietary capital for educational purposes only and publishes to the selected broker firm under their licensing umbrella. The Company does not guarantee the accuracy or completeness of any information on the services provided by our partners. The Company does not provide financial advice of any kind and often refers to its the services as ’’solutions”. The Company’s services are not directed at or intended for use by individuals or entities residing in jurisdictions where such distribution may violate applicable laws or regulations. The clients are fully responsible for ensuring that they comply with the laws and regulations of their jurisdiction. The Company, its officers, employees, affiliates, partners, and agents expressly disclaim any liability for clients actions which result in violation of applicable laws or regulations.

Details regarding any applicable fees or charges associated with our services are available on our website or through agreements with our partners. All compensations, including commissions and performance-based fees are paid by our partners (example: Vantage Markets, Darwinex), under their regulatory framework, using their own internal systems. These payments are governed by agreements between TradePoint Capital, TradePoint Capital’s affiliates,Vantage Markets and Darwinex, in compliance with applicable laws and regulations. TradePoint Capital does not act as an introducing broker or financial intermediary.

10. Restricted Sharing and Reselling

You are expressly prohibited from sharing, reselling, or distributing The Company’s content without explicit permission from The Company. The content is for your personal use only and may not be shared or resold in any form, including but not limited to online forums, social media, email, or any other platform. This website contains materials that The Company owns or has the license to use. If any kind of trademarks are falsely used by The Company, we should be immediately contacted via email (info@tradepointcapital.org) and we will remove as soon as possible. TradePoint Capital is the owner of all strategies which consists in trade secrets and other sensitive, purely confidential information which is not available to the public. All the educational materials are confidential and all of them are the intellectual property of the sole proprietor of the proper education section. To separate the education sections, the Hungarian education is governed by the Hungarian Sole-Proprietor, and the English education is governed by the UAE affiliate. Any proprietary methodologies, trade logic, or analytical tools referenced on this website remain the intellectual property of the operators of The Company and the affiliates. The Company is not held liable for any misuse or false usage of these trademarks.

Trading Education is provided by the above mentioned sole proprietor until further notice. The UAE based affiliate is governing only the english education and it is currently unavailable.

You can check the performance of our strategies without being involved from a third-party provider named as Myfxbook. who acts as an independent third-party strategy performance auditor.

12.7. Mutual Non-Disclosure Agreement

By subscribing to the strategies, you accept these terms and the broker’s own terms and conditions and potentially other legal documentations. TradePoint Capital, Vantage Markets and Darwinex reserves the right to amend, update, or modify their own Terms & Conditions at any time without prior notice. All changes shall be deemed automatically accepted and contractually binding upon all clients — including existing and past clients — and shall apply to any current and any future activity within the services. directly between you and your broker. TradePoint Capital does not open, operate, or manage brokerage accounts on behalf of clients. We never hold or access client funds, and we do not accept discretionary authority over any account. All the clients can subscribe and exit the strategy at any given time. This policy is in place to protect the clients, ensure regulatory compliance of the partner brokerage, and maintain the integrity and security of all client accounts and the reputation of the involved parties. All the associated parties agree to keep all confidential informations shared between them strictly private. Confidential information includes any non-public, proprietary, or sensitive material disclosed during discussions. Neither party will disclose such information to any third party or use it for any purpose other than evaluating a potential business relationship. This obligation does not apply to information that is public, already known, independently developed, or legally obtained from another source.

12.8. Verification and Strategy Audit

The displayed strategies are verified and audited by a third party service provider called Myfxbook to ensure the integrity and authenticity of the strategies, and it’s accessible to the general public via Myfxbook’s official website. The verification methodology falls solely under Myfxbook and we do not have any kind of oversight of their business conduct.

12.9. Fund Custody and Withdrawals

TradePoint Capital does not hold or otherwise have control over client funds. All funds deposited by clients for the purposes of using TradePoint Capital's “Copy Our Strategy” solutions are held by Vantage Markets (“Vantage”) and Darwinex. Vantage maintains segregated client trust accounts, with top-tier banks, as an extra layer of protection of client's funds. Vantage is a fully regulated entity, holding licenses from the Financial Conduct Authority (FCA) in the UK, the Financial Sector Conduct Authority (FSCA) in South Africa, the Cayman Islands Monetary Authority (CIMA), the Australian Securities and Investments Commission (ASIC) in Australia, the Vanuatu Financial Services Commission (VFSC) in Vanuatu and the Financial Services Commission (FSC) in Mauritius. Vantage utilizes top-tier liquidity providers top-tier banks including J.P.Morgan, HSBC, RBS, Citibank, Nomura, and Goldman Sachs. Vantage has arranged for enhanced protection through insurance by Lloyd's of London, providing coverage of up to US $1,000,000 per claimant. Deposits from eligible clients registered with Darwinex CNMV-regulated entity in Spain, are protected via FOGAIN that offers coverage up to 100,000 EUR. This comprehensive insurance coverage is included at no additional cost and ensures that clients' funds are protected in the unlikely event that Darwinex is unable to meet its financial obligations. All financial transactions, including trades, deposits and withdrawals or strategy subscriptions, are conducted directly through a fully regulated third-party broker, named as Vantage Markets and Darwinex, which provides clients with secure 24/7 access to their accounts via a dedicated client portal. Clients are dealing directly with the broker while maintaining full control over their funds at all times and can withdraw or deposit in accordance with the broker’s t&c. All funds deposited by clients are held by Vantage Markets and Darwinex. All the clients can subscribe and exit the displayed strategies at any given time. This policy is in place to protect the clients, ensure regulatory compliance, and maintain the integrity and security of all client accounts and the reputation of TradePoint Capital, Vantage Markets and Darwinex.

The Services are provided on an "as is" and "as available" basis. The Company makes no representations or warranties of any kind, express or implied, as to the operation of the Services or the information, content, materials, or products included on the Services. You concur that if you rely on any of the information and content on this website, you do so at your own risk. The exclusive jurisdiction for any disputes arising from this Agreement shall be the courts of the Bahamas, with appeals as permitted to the Bahamian Court of Appeal.
